Terms and Conditions
These Terms and Conditions govern your use of the Treme Place website and your submission of an inquiry, quote request, booking request, or reservation for a stay at Treme Place.
In these Terms, “Treme Place,” “we,” “us,” and “our” refer to Treme Place LLC. “Guest,” “you,” and “your” refer to the person using the website, requesting or making a reservation, signing a rental agreement, paying for a stay, or occupying an apartment.
Additional terms may be presented in a quote, booking confirmation, rental agreement, payment authorization, house rules, booking platform, or company-housing agreement. If there is a conflict, the terms specifically accepted for the reservation will control with respect to that reservation.
1. Acceptance of These Terms
By using this website, submitting an inquiry or booking request, making a payment, signing a rental agreement, or occupying an apartment, you acknowledge that you have read and agree to these Terms and Conditions.
You must be legally able to enter into a binding agreement to make a reservation. The person making the reservation is responsible for ensuring that all occupants and approved visitors comply with the applicable reservation terms and house rules.
2. About Treme Place
Treme Place provides furnished apartments in the historic Tremé neighborhood of New Orleans. Apartments may be offered for leisure travel, business travel, relocation, healthcare assignments, film and production housing, insurance-related temporary housing, government travel, and other approved short-term or mid-term stays.
Treme Place is a restored historic residential property. Apartment layouts, architectural details, floor levels, exterior conditions, accessibility features, and other characteristics may differ from those found in newly constructed hotels or apartment buildings.
3. Booking Requests and Reservation Approval
Submitting an inquiry, availability request, quote request, or booking request does not create or guarantee a reservation.
Reservations are subject to review and approval by Treme Place. We may request additional information before accepting a booking, including information regarding the guest, occupants, purpose of the stay, employer, company payer, payment method, or other reasonable reservation details.
A reservation is confirmed only after Treme Place has approved the booking and any required payment, deposit, identification, agreement, authorization, or other booking requirement has been completed.
Availability may change until a reservation is confirmed. Treme Place may decline a booking request when permitted by law.
4. Rates, Quotes, Taxes, and Fees
Rates vary according to the apartment, season, dates, length of stay, booking channel, occupancy, demand, and other applicable factors.
A quoted price may include or separately identify:
- Nightly or monthly rent
- Cleaning fees
- Taxes
- Booking or processing fees
- Pet fees, when an exception is approved
- Damage protection or security-deposit requirements
- Additional services approved by the guest
Quotes may expire at the time stated in the quote or booking communication. Rates and availability are not guaranteed until the reservation is confirmed.
We attempt to present accurate pricing. However, clerical, technical, calculation, synchronization, or channel errors may occasionally occur. When legally permitted, Treme Place may correct an obvious pricing or availability error before a reservation is confirmed.
5. Payments
Payment requirements are provided during the booking process and may vary depending on the apartment, dates, length of stay, booking channel, rate, and payment arrangement.
A reservation may require:
- A deposit at the time of booking
- Full advance payment
- Scheduled installment payments
- A security deposit or payment-card authorization
- Damage protection
- Company billing approval
By providing a payment method, you represent that you are authorized to use it and authorize the applicable charges described in the quote, confirmation, rental agreement, or booking terms.
Unpaid balances, declined payments, reversed payments, chargebacks, or failure to complete required payment steps may result in cancellation of the reservation, denial of check-in, or collection activity when permitted by law.
6. Cancellations, Changes, and Refunds
Cancellation, modification, and refund terms are provided during the booking process. They may vary according to:
- The apartment
- The reservation dates
- The length of stay
- The selected rate
- The booking channel
- A company or professional-housing agreement
Guests are responsible for reviewing the applicable cancellation terms before confirming a reservation.
Requests to shorten, extend, transfer, postpone, or otherwise modify a reservation are subject to availability, approval, repricing, and any applicable fees or cancellation terms.
Failure to arrive, late arrival, early departure, travel disruption, illness, weather concerns, event cancellation, or a change in personal or business plans does not automatically create a right to a refund.
7. Reservations Through Third-Party Channels
Reservations may be offered through services such as Airbnb, Vrbo, OwnerRez, or other booking and professional-housing platforms.
Reservations made through a third-party channel are also subject to that channel’s terms, payment procedures, cancellation rules, refund procedures, and dispute processes.
When a third-party channel controls payment or cancellation processing, the guest may be required to submit requests directly through that platform.
8. Rental Agreement and Guest Verification
Treme Place may require the primary guest or responsible party to complete a rental agreement, provide valid identification, verify contact information, authorize payment, or satisfy other reasonable screening or booking requirements.
Failure to provide requested information or complete required booking steps may result in the reservation being declined or canceled.
Information provided during booking must be accurate and complete. Reservations may not be made using a false identity, unauthorized payment method, or materially misleading information.
9. Registered Guests and Occupancy
Only registered and approved guests may occupy the apartment overnight. The maximum occupancy is two people per apartment unless Treme Place expressly approves a different arrangement in writing.
The reservation may not be assigned, transferred, resold, advertised, or used by a person who was not approved as part of the booking.
Visitors require prior approval. Unauthorized occupants, rotating occupants, excessive visitors, or use of the apartment by persons not included in the reservation may result in additional charges, termination of the stay, or removal from the property when permitted by law.
10. House Rules
All guests, occupants, and approved visitors must follow the Treme Place House Rules.
Important requirements include:
- Quiet hours from 10:00 PM to 8:00 AM
- No parties, events, or large gatherings
- No unauthorized commercial activities
- No smoking inside the apartments
- No unauthorized pets
- Respect for neighbors and the surrounding community
- Compliance with occupancy and visitor limits
- Proper care of the apartment, furnishings, and common areas
A serious or repeated violation may result in cancellation or termination of the stay without a refund when permitted by the applicable reservation terms and law.
11. Smoking
Smoking is not permitted inside any apartment. This restriction includes cigarettes, cigars, pipes, cannabis, vaping devices, electronic cigarettes, and similar products.
Guests may be responsible for reasonable cleaning, deodorizing, repair, replacement, loss-of-use, or other costs caused by a violation of the smoking policy.
12. Pets and Assistance Animals
Pets are generally not accepted. Any exception must be approved in writing before booking or before the animal is brought onto the property.
Approved pets may be subject to additional terms, fees, cleaning requirements, and damage responsibility.
Assistance animals are addressed separately in accordance with applicable legal requirements. Guests seeking a reasonable accommodation should contact Treme Place before arrival whenever possible so that the request can be addressed appropriately.
13. Check-In and Check-Out
Check-in and check-out times will be provided in the booking confirmation or arrival instructions.
Early check-in and late check-out are not guaranteed and require prior written approval. Additional charges may apply.
Guests must vacate the apartment by the approved check-out time, remove personal belongings, return any provided access items, and follow the departure instructions.
14. Access Codes and Property Security
Guests may receive a temporary door code or other access credential. Access information must not be shared with unauthorized persons.
Guests must promptly report a lost device, compromised code, suspected unauthorized entry, or other security concern.
Access credentials may expire or be deactivated at check-out, cancellation, termination of the stay, or when reasonably necessary to protect the property or its occupants.
15. Property Condition, Damage, and Excessive Cleaning
Guests must use the apartment and furnishings carefully and report damage, breakage, leaks, safety concerns, pests, or maintenance issues promptly.
The guest or responsible booking party may be charged for costs resulting from:
- Damage beyond ordinary wear and tear
- Missing or destroyed property
- Unauthorized smoking or pets
- Excessive cleaning
- Stains, odors, or contamination requiring special treatment
- Unauthorized occupants, parties, or events
- Damage caused by guests, visitors, or approved animals
- Lost keys, access devices, or security-related replacement costs
- Loss of rental use caused by guest damage
When possible, charges will be supported by reasonable documentation such as photographs, invoices, estimates, inspection records, or booking-platform documentation.
16. Maintenance and Property Access
Guests must notify Treme Place promptly when a maintenance issue, safety issue, leak, electrical problem, appliance failure, pest concern, or other property problem is discovered.
Treme Place and its authorized representatives may access an apartment when reasonably necessary and as permitted by applicable law, including for:
- Emergency response
- Urgent repairs
- Guest-requested maintenance
- Protection of people or property
- Investigation of a suspected material rule violation
- Required inspections or legal compliance
Except in emergencies or when immediate access is reasonably necessary, we will attempt to provide reasonable notice.
17. Utilities, Internet, and Service Interruptions
Utilities and internet service are generally included unless otherwise stated in the reservation terms.
Utility, internet, cellular, television, appliance, or other service interruptions may occur due to provider outages, weather, repairs, infrastructure conditions, or circumstances outside our reasonable control.
Treme Place will make reasonable efforts to address issues within its control but does not guarantee uninterrupted service.
18. Parking and Vehicles
Treme Place does not provide reserved private parking. Public street parking may be available nearby but is not guaranteed.
Guests are responsible for reviewing and following all posted signs, temporary restrictions, permit requirements, street-cleaning schedules, construction notices, event restrictions, and other city parking rules.
To the maximum extent permitted by law, Treme Place is not responsible for parking citations, towing, theft, vandalism, vehicle damage, flooding, falling debris, or loss involving a vehicle parked on a public street or elsewhere.
19. Historic Property and Neighborhood Conditions
Treme Place is located in a historic urban neighborhood. Guests may encounter normal city and neighborhood conditions, including street activity, music, traffic, pedestrians, celebrations, construction, emergency vehicles, uneven sidewalks, weather-related conditions, and other sounds or activity outside Treme Place’s control.
Photographs and descriptions are intended to present the apartments accurately, but furnishings, artwork, decor, landscaping, fixtures, and minor details may change over time.
20. Personal Property
Guests are responsible for securing their money, identification, electronics, vehicles, luggage, and other personal property.
To the maximum extent permitted by law, Treme Place is not responsible for lost, stolen, forgotten, or damaged personal property unless the loss was directly caused by conduct for which liability cannot legally be excluded.
We may make a reasonable effort to locate and return items left behind. Shipping, handling, storage, and administrative costs may be charged to the guest. Unclaimed items may be discarded or donated after a reasonable period.
21. Safety and Emergencies
Guests must use appliances, locks, entrances, furniture, and other property features responsibly and follow any posted or communicated safety instructions.
In an emergency involving immediate danger, fire, crime, or a medical emergency, contact 911 before contacting Treme Place.
Guests must not disable, cover, tamper with, or remove smoke alarms, carbon-monoxide alarms, locks, cameras located in permitted exterior or common areas, or other safety and security equipment.
22. Professional and Company-Paid Housing
Company-paid, insurance, relocation, healthcare, production, government, university, or other professional-housing arrangements may be subject to separate terms addressing:
- Direct billing
- Purchase orders
- Monthly invoicing
- Authorized occupants
- Extensions and early departures
- Company payment responsibility
- Tax documentation
- Insurance or relocation requirements
A company’s agreement to pay does not automatically release the guest from responsibility unless Treme Place expressly agrees otherwise in writing.
23. Prohibited Uses
The apartments and website may not be used for:
- Illegal activity
- Fraudulent or deceptive booking activity
- Unauthorized parties or events
- Unauthorized filming, photography, or commercial production
- Resale, subletting, or transfer of a reservation
- Activities that create a safety hazard or public nuisance
- Conduct that threatens guests, neighbors, staff, or property
- Interference with website or booking-system security
24. Force Majeure and Events Beyond Our Control
Treme Place is not responsible for a delay, interruption, inability to perform, or loss caused by circumstances beyond its reasonable control.
Such circumstances may include:
- Hurricanes, tropical storms, floods, tornadoes, or severe weather
- Fire or natural disaster
- Power, water, internet, or utility failure
- Government orders or emergency declarations
- Evacuation orders or travel restrictions
- Epidemics or public-health emergencies
- Civil unrest, terrorism, or acts of war
- Labor disputes or transportation interruptions
- Unexpected building or infrastructure emergencies
Any cancellation, relocation, credit, or refund resulting from such an event will be determined under the applicable reservation terms, booking-channel rules, insurance coverage, and law.
25. Website Information and Availability
We strive to keep website information accurate and current. However, we do not guarantee that every description, photograph, price, availability result, amenity, neighborhood listing, business recommendation, or external link will always be complete or error-free.
Nearby restaurants, attractions, transportation options, businesses, events, and services are independently operated and may change without notice.
Website access may occasionally be interrupted for maintenance, updates, technical failures, security issues, or circumstances beyond our control.
26. Third-Party Services
The website may include links, widgets, maps, booking services, payment services, or other functionality provided by third parties.
These providers may have their own terms, privacy policies, fees, limitations, and security practices. Treme Place is not responsible for the operation or content of a service that it does not control.
27. Intellectual Property
The Treme Place name, logo, website design, written descriptions, photographs, graphics, branding, and other original content are owned by or licensed to Treme Place and are protected by applicable intellectual-property laws.
You may view and use the website for personal, noncommercial purposes related to evaluating or arranging a stay.
You may not copy, republish, distribute, scrape, reproduce, modify, sell, or commercially exploit Treme Place content without prior written permission.
28. Privacy
Information collected through the website, booking process, and guest relationship is handled as described in the Treme Place Privacy Policy.
29. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
To the maximum extent permitted by law, Treme Place will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the website, a third-party service, or a stay at the property.
Treme Place is not responsible for losses caused by a guest’s failure to follow these Terms, the House Rules, safety instructions, parking regulations, booking-channel rules, or applicable law.
30. Guest Responsibility and Indemnification
To the extent permitted by law, the guest and responsible booking party agree to be responsible for claims, losses, damages, charges, and reasonable costs arising from:
- Their violation of these Terms or the House Rules
- Damage caused by them, their occupants, visitors, or animals
- Their unlawful, negligent, or unauthorized conduct
- Their misuse of the apartment or website
This provision does not require a guest to assume responsibility for conduct legally attributable solely to Treme Place.
31. Termination of a Stay
Treme Place may terminate or cancel a stay when permitted by law and the applicable reservation terms if a guest:
- Fails to pay required amounts
- Provides materially false booking information
- Exceeds occupancy limits
- Hosts an unauthorized party or event
- Creates a serious safety risk or nuisance
- Engages in illegal activity
- Causes material damage
- Seriously or repeatedly violates the House Rules
Refund eligibility, if any, will be determined under the applicable booking terms and law.
32. Governing Law and Venue
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.
Unless another process is required by an applicable booking platform, agreement, or law, legal proceedings relating to these Terms or a stay at Treme Place shall be brought in a court of competent jurisdiction in Orleans Parish, Louisiana.
33. Severability
If any provision of these Terms is found to be invalid, unenforceable, or unlawful, the remaining provisions will continue in effect to the fullest extent permitted by law.
34. No Waiver
A failure or delay by Treme Place in enforcing a provision does not waive the right to enforce that provision or any other provision later.
35. Changes to These Terms
Treme Place may update these Terms as its website, services, booking practices, providers, or legal obligations change.
Revised Terms will be posted on this page with an updated effective date. Updated Terms apply to future website use and future reservations unless otherwise stated.
The terms accepted at the time of a confirmed reservation will continue to govern that reservation unless the parties agree to a change or applicable law requires otherwise.
